This Agreement on the protection of personal data of users (hereinafter referred to as the Privacy Policy) applies to all information that the Website, located at www.migpromo.kz, may receive about the User during his/her use of the Website.
DEFINITION OF TERMS
1.1. The following definitions are used within the framework of this Privacy Policy: 1.1.1. "Website Administration" - authorized representatives managing the website on behalf of Migpromo IP, organizing and/or processing personal data, as well as determining the purposes of such processing, the list of personal data subject to processing, and the actions performed with the data.
1.1.2. "Personal data" - any information related to a specific or potentially identifiable subject of personal data.
1.1.3. "Personal data processing" - any actions or set of actions performed using automated means or without them, including the collection, recording, systematization, accumulation, storage, clarification, extraction, use, transfer, depersonalization, blocking, deletion and destruction of personal data.
1.1.4. "Confidentiality of personal data" - a mandatory requirement for the Operator or other persons who have gained access to personal data to prevent their dissemination without the consent of the data subject or other legal basis.
1.1.5. "User" - a person who has gained access to the Site via the Internet and uses its resources.
1.1.6. «Cookies» – a small piece of data sent by a web server and stored on the user's device, which the web client or web browser sends back to the web server each time a page of the corresponding site is requested.
1.1.7. «IP address» – a unique network address of a node in a computer network using the IP protocol.
GENERAL PROVISIONS
2.1. The User's use of the www.migpromo.kz website signifies his/her consent to this Privacy Policy and the rules for processing personal data.
2.2. In case of disagreement with the terms of the Privacy Policy, the User is obliged to stop using the www.migpromo.kz website.
2.3. This Privacy Policy applies exclusively to the www.migpromo.kz website and its subdomains. IP "Migpromo" is not responsible for third-party websites that the User can access via links posted on the website www.migpromo.kz.
2.4. The website administration does not verify the accuracy of personal data provided by Users of the website www.migpromo.kz.
SUBJECT OF PRIVACY POLICY
3.1. This Privacy Policy defines the obligations of the Administration of the website www.migpromo.kz to protect and ensure the privacy of personal data provided by the User when registering on the website or placing an order for services.
3.2. Personal data that may be processed within the framework of this Privacy Policy are provided by the User by filling out the registration form on the website www.migpromo.kz and include:
3.2.1. User's name and/or title;
3.2.2. User's contact phone number;
3.2.3. Email address;
3.2.4. IIN and/or BIN;
3.2.5. Form of ownership.
3.3. Migpromo IP protects data that is automatically transmitted when visiting pages with the installed statistical script of the system ("pixel"):
— IP address;
— information from cookies;
— data about the browser (or other program that provides access to advertising);
— access time; — the address of the page where the ad unit is placed;
— referrer (address of the previous page).
3.3.1. Disabling cookies may affect the ability to access sections of the site that require authorization.
3.3.2. IP "Migpromo" collects statistics on the IP addresses of visitors to identify and eliminate technical problems.
3.4. Any additional personal information (history of requests, browsers used, operating systems, etc.) not specified above, is subject to secure storage and is not disclosed, except for cases provided for in paragraphs. 5.2. and 5.3. of this Policy.
PURPOSES OF COLLECTING THE USER'S PERSONAL INFORMATION
4.1. The User's personal data may be used by the Site Administration for the following purposes:
4.1.1. Identification of the User registered on the www.migpromo.kz website for placing orders and further interaction.
4.1.2. Providing the User with access to the personalized resources of the Internet Portal.
4.1.3. Establishing feedback with the User, including sending notifications and requests related to the use of the Internet Portal, provision of services, feedback processing of applications.
4.1.4. Determining the location of the User to ensure security and prevent fraud.
4.1.5. Verifying the authenticity of the personal data provided by the User.
4.1.6. Creating an account for submitting applications (with the consent of the User).
4.1.7. Notifying the User about the status of his order on the website www.migpromo.kz.
4.1.8. Providing customer and technical support in the event of questions related to the use of the website.
4.1.9. Agreed provision of updates, special offers, price information, newsletters on behalf of www.migpromo.kz or on behalf of its partners.
4.1.10. Carrying out advertising activities with the consent of the User.
4.1.11. Providing access to the websites or services of Migpromo IP partners to receive products, services and updates.
METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION
5.1. Personal data is processed for an unlimited period, by any legal means, including automated systems or their absence.
5.2. The site administration has the right to transfer personal data to third parties, such as courier services, postal organizations, telecom operators, solely for the purpose of fulfilling the User's order.
5.3. Transfer of data to government agencies is permitted only within the framework of the legislation of the Republic of Kazakhstan.
5.4. In the event of loss or disclosure of data, the Administration informs the User of this fact.
5.5. The Site Administration takes all necessary measures to protect personal data from unauthorized access, destruction, modification or other actions.
5.6. In cooperation with the User, the Site Administration takes measures to prevent losses or other consequences caused by the loss or disclosure of data.
OBLIGATIONS OF THE PARTIES
6.1. The User is obliged to:
6.1.1. Provide the data necessary for using the www.migpromo.kz site.
6.1.2. Update and supplement the provided personal data when they change.
6.2. The Site Administration is obliged to:
6.2.1. Use the data solely for the purposes specified in the Privacy Policy.
6.2.2. Ensure the confidentiality of data, do not transfer it to third parties without the consent of the User, with the exception of paragraphs 5.2. and 5.3.
6.2.3. Take measures to protect personal data applied in business practice.
6.2.4. Block the User's personal data at his request for the duration of verification in case of detection of inaccuracies or illegal actions.
LIABILITY OF THE PARTIES
7.1. The Site Administration is liable for losses incurred by the User due to the unauthorized use of personal data, in accordance with the legislation of the Republic of Kazakhstan, with the exception of cases specified in paragraphs 5.2., 5.3. and 7.2.
7.2. The Site Administration is released from liability if the information:
7.2.1. Became public before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Site Administration.
7.2.3. Disclosed with the consent of the User.
DISPUTE RESOLUTION
8.1. Before filing a claim, the parties undertake to attempt to resolve the dispute out of court through claims.
8.2. A response to the claim is provided within 30 calendar days from the date of its receipt.
8.3. If an agreement is not reached, the dispute is referred to the court in accordance with the legislation of the Republic of Kazakhstan.
8.4. The privacy policy is governed by the legislation of the Republic of Kazakhstan.
ADDITIONAL TERMS
9.1. The Site Administration has the right to make changes to this Privacy Policy without notifying the User.
9.2. The new version comes into force from the moment of its publication on the website www.migpromo.kz, unless otherwise specified in the new version.
